The case of culpable homicide against former North West Human Settlement, Safety, and Liaison MEC Nono Maloyi has not been struck off the roll. Maloyi, who faces a charge of culpable homicide, has a new battle on his hands after a letter by ANC members directed to the party’s Integrity Commission to have Maloyi step-aside until he has thoroughly cleansed his name of the charges.

Maloyi applied for representation to the office of the National Director of Public Prosecutions (NDPP) for his case to be struck off the roll after his provincial attempt failed.

He is said to be vying for the position of the province’s chair which may see him become the premier.

“Should the application be rejected, a new court date will be decided upon,” said NPA spokesperson in North West, Henry Mamothame.

Maloyi is facing a charge of culpable homicide, following a fatal crash that resulted in the death of one woman, in 2018.

It is alleged that on the night of September 1, 2018, Maloyi was travelling at an extremely high speed, on the N12 between Klerksdorp and Stilfontein, when he crashed into another vehicle that had two occupants.

The ANC has reaffirmed its position on the step-aside rule as the provinces conclude their provincial elective conferences.

Speaking to The Star, Mamothame said: “Maloyi’s matter is pending the outcome of the application. He cannot withdraw the case himself. Only the NPA can withdraw the case”.

Asked why Maloyi told the SABC that the case was over, Momathame said: “Maloyi needs a better understanding than of the law. That information is incorrect”.
