Johannesburg - The National Union of Metalworkers of South Africa’s (Numsa) urgent application to be reinstated within Cosatu and appeal its dismissal at the July special national congress has been denied by the South Gauteng High Court, and the matter thrown out of court.

Acting Judge AJ Mbongwe told the union that it had sufficient time in the past to bring their application to court but failed to do so. “It appears to me, this is a serious afterthought on the part of the applicant,” said the judge.

Cosatu and its affiliates had also filed papers as respondents in the matter arguing that the federation would grant Numsa ample opportunity to appeal its expulsion at Cosatu's ordinary congress in November.
