Family, friends protest against bail for hit-and-run driver

Durban - The only survivor of a hit-and-run near Durban’s Blue Lagoon stood outside the Durban Magistrate’s Court building on Thursday, saying he could not face the alleged driver in court.

Phoenix resident, Junaid Singh, was with friends and the families of his two friends, Sumeer Maharaj, 26, and Pravin Mahabir, 25, who were killed while helping him change a flat tyre on his bakkie.

Their respective vehicles had been parked in the emergency lane on the M4 Northern Freeway, near the Blue Lagoon on-ramp, on May 18.

The relatives and friends will return to court next week when 28-year-old Kearadilwe Refilwe Modise Moloto, of Sunnydale, in Gauteng, is expected to apply for bail.

“I’m not sleeping well at all. I have to take sleeping tablets. I keep dreaming about (it),” said Singh.

Maharaj and Mahabir’s family said they were still finding it difficult to cope with their relatives’ deaths.

Moloto is facing two counts of culpable homicide as well as charges of reckless and negligent driving, failing to perform the duties of a driver after an accident and defeating the ends of justice.

It is alleged that she was driving her black Kia, with GP registration, when she struck Maharaj and Mahabir. Singh was also hit, injuring his hand.

Maharaj died at the scene and Mahabir died the next day in hospital.

The driver allegedly did not stop after the accident.

It is alleged Moloto filed a false accident report and attempted to have the car repaired.

The car was apparently taken to a local panel beater, who then reported the matter to police after recognising the colour and model of the vehicle mentioned in media reports.

On Thursday, Moloto appeared briefly in court with new legal counsel.

Prosecutor Sharon Moodley said the State was still opposed to bail and asked for the matter to be adjourned until Tuesday.
