Durban - Provincial police commissioner, Lieutenant-General Mmamonnye Ngobeni, was at work for just a week when she was told to vacate her office.

This follows the acting national police commissioner’s decision to apply for leave to appeal against the high court judgment that set aside her suspension.

Durban High Court Judge Nkosinathi Chili handed down his judgment on Wednesday last week. He also ordered that the decision to establish a board of inquiry to investigate allegations of misconduct against her, also be set aside.

Ngobeni’s attorney, Ravindra Maniklall, on Wednesday confirmed they received notice of the application for leave to appeal and said they had already filed their opposing court papers.

“The file is now with the judge and a date is to be decided for argument to be heard,” he said.

He said Ngobeni had already assigned the former acting provincial commissioner to stand in while she awaits a decision from the court.

He confirmed that the suspension officially started on Monday.

National police spokeswoman, Brigadier Mashadi Selepe did not confirm or deny that the national police commissioner would be appealing the judgment saying they did not want to “peddle such information through the media”.

The provincial police commissioner was suspended in May, and also received notice from acting national police commissioner, Lieutenant-General Khomotso Phahlane, that he would establish a board of inquiry into her fitness to hold office.
