Cape Town - Charges against the owner of Barron’s Estate & Caterers, accused of assaulting two boys, were dropped before they could reach court.

The 57-year-old’s man’s case was struck off the court roll at the Athlone Magistrates’ Court on Monday after the matter was reviewed by the Senior State Prosecutor.

The man’s lawyer Yazeed Galant confirmed the State decided not to prosecute or continue with the matter because the victims’ case was weak.

“It is false accusations and the State decided not to proceed and it was struck off the roll, nolle prosequi. The prosecution felt there was a lack of truth in the matter,” he told Daily Voice.

The boy’s father is now upset and plans to challenge the decision.

The accused was charged with common assault on Saturday at Philippi Police Station, after he was accused of pushing two boys, aged nine and 10, down the stairs at a wedding held at his estate in Schaapkraal, Philippi.

The nine-year-old, whose father owns a well-known construction company, was left with a flesh wound to his hand.

While the dad is happy that the story “has gone viral” on social media, he was angry that the matter has been dropped.

“The J88 form wasn’t even in the docket, it was still at the hospital, and the case was struck off the roll,” he said.

Mitchells Plain CPF cluster chairperson Hanif Loonat, who is assisting the family, said he intends ”to take the matter further”.

“We want answers from the senior state prosecutor,” he said.
