Johannesburg – IOL apologises for a story we carried earlier on Wednesday suggesting that Judge Mabel Jansen could potentially be criminally prosecuted retroactively for controversial comments she made last year. 

Jansen cannot be criminally charged as the new proposed Hate Crimes Bill cannot be retrospective.

Last year writer Gillian Schutte brought a misconduct complaint to the Judicial Conduct Committee after a private conversation she had with Judge Jansen on Facebook, where the latter stated that rape and murder were part of black people’s culture – which made her “feel like vomiting”.

The judge has been placed on special leave while the JCC continues to deliberate whether Jansen has a case to answer to.
