RAF ruling could trigger claims avalanche

Johannesburg - A lawyer for the Road Accident Fund says a ruling by the Constitutional Court this week paves the way for road accident victims to pursue claims amounting potentially to millions of rand against lawyers who assisted them to successfully claim from the fund but then charged fees in excess of the law.

However, Johannesburg lawyer Ronald Bobroff says the court did not suggest any improper or unethical conduct on the part of any attorney when it dismissed applications by personal injury lawyers for leave to appeal rulings against the fees they have been charging on a no-win no-fee or contingency basis. Bobroff’s firm, Ronald Bobroff & Partners, had applied for leave to appeal a High Court finding that its contingency fee agreement with a former client was void because it exceeded limits set by the Contingency Fees Act.
