Remove case from roll: accused’s lawyer

A criminal case brought against the son of a Durban tycoon after a nightclub brawl earlier this year should be removed from the court roll, the man’s lawyer argued on Thursday.

The accused, Rahul Sewnarain, 24, faces an allegation of assault with intent to do grievous bodily harm for allegedly hitting a student Nicoli Francois, in the face with a beer glass at the Jus Jazzin nightclub in Durban North on February 18.

Sewnarain, the son of businessman Ashok Sewnarain, appeared briefly in the Durban Magistrate’s Court yesterday.

He is on R1 000 bail. His attorney Anand Nepaul, said the matter should be struck off the roll and re-instated only once the director of Public Prosecutions decided it was worth pursuing.

He made the request on the basis that the defence had been given one docket by the State, when there should have been two dockets. The defence had also asked for colour copies of photographs of the complainant in the evidence file, he said.

 

While the State responded that it was ready to proceed with the matter with the evidence from the one docket, the court ordered the State to provide the outstanding material to the defence by June 25.

The matter was adjourned to July 18. – Daily News
