Father kills daughter’s alleged rapist

An Ulundi policeman lost faith in the criminal justice system after his baby daughter was raped – and now he will spend the rest of his life in jail for murdering two fellow police officers and the alleged culprit.

In a guilty plea, confirmed this week by Judge Dhaya Pillay, sitting in the Mtunzini High Court, the policeman – who cannot be named to protect the identity of his daughter – admitted being angry at the handling of the alleged rape of his daughter by a boy aged 13.

His shooting spree was preceded by an angry row in the office of the local police superintendent.

According to evidence before the court, the child was allegedly raped by the boy in January 2009 when she was just two-and-a-half. The youth was arrested, appeared in court and was released into the care of his guardian.

But the policeman believed he was being treated leniently and that the case was not being investigated properly.

In the presence of police clerk Joyce Fikile Gumede, the policeman complained to Ulundi superintendent, Pridesworth Bongiwe Masemola, but, he said, “they treated me badly”.

In his written plea, the policeman said in May that year the investigating officer in the rape case, Zephania Ntshayintshayi, had called him, asking him to bring his daughter to a child protection awareness function organised by the Ulundi police station.

Just after the function started, he had seen Ntshayintshayi and Gumede standing outside.

“I was angry at them as they had not handled my child’s case the way they should have. I was also angry at Gumede and Masemola for treating me badly.

“I drew my service pistol and went to Ntshayintshayi asking if he still remembers me… I then pulled the trigger, hitting him twice. Gumede tried to run away, but I shot her several times in the back.

“I then went around the tent looking for Masemola...”

He said that, when he found her, he shot her several times without noticing which part of her body he was shooting at.

Both Gumede and Masemola died.

The policeman then drove to the alleged rapist’s school.

After forcibly dispossessing a security guard of his firearm, he took the teenager out of the school and shot him as he was leaning up against a wall.

As he fled, he threatened another man with his gun, telling him to keep quiet.

He went home and shot himself, but survived.

Judge Pillay sentenced him to 15 years in jail for the murder of Gumede, 24 years for the murder of Masemola, seven years for the attempted murder of Ntshayintshayi, 15 years for robbing the security guard of his pistol and two years for pointing a firearm.

These sentences all run concurrently with the life sentence he received for the murder of the alleged teenage rapist. - The Mercury

This is so sad. He was only protecting his child, like every father should do. I do not believe he should get life in prison. How unjust is our system that he is severely punished for taking the law into his own hands? Murder is a crime. i do agree with that, and he didnt need to murder those policemen. but rape is a crime too!!! and rape of a baby??? Its just warped and sick. the whole story. my heart bleeds for that little baby girl.

The justice system failed this poor man.Looking at your kids innocent face everyday & knowing that someone hurt them like that..If it happened to my kid, i would have also done the same

Glad at least the rapist is dead, but tragic that the police officers were killed too. Perhaps if they had been more comptetent, none of this would have happened.

they should stop employing imbeciles into our police force - that here is the issue - stupiduntrainedlazy police that would rather do nothing (or arrest a harmless rasta or something) than actually doing proper decent polie work that they were employed to do makes me sick

All who say "while I can't condone" and "not saying it's right", and then go on to praise this killer are justifying and minimizing the crime of murder. You praise this man as a "father", but what kind of father sets his children the example of murder? You pretend to care for victims, yet you praise the murder of two people who had committed no crime. You say society is sick? Look within yourselves for the disease. If you are the voice of "morality" in this country, we are all beyond saving.

not saying what he did was right, however as said many times before - there is something very worng and sick in our society today that our children are abusedmurderedraped in this country - perhaps these types of actions would make potential would be offenders think twice!!!

The blame should be apportioned on the criminal justice system for failing the victim and her father. These two people needed urgent councelling and the two murderd officers were the ones responsible ensuring that the case is given proper attention but instead they treated the Dipressed father badly. Justice system should bring back the trust which the public has lost and things like this will not happen.

I cannot imagine having my 2 yr old daughter raped, or what my reaction would be! This father as a policeman had the justice system fail him? Whilst I in no way condone his actions, I can't say that I would never do same!!!

So, worsie, you have absolutely no sympathy for the two murdered police officials, their families, or anyone else who might have got in the way of this killer? You can try to justify it all you like, and you can hurl all the insults you like at people with morals who condemn murder, but murder is murder, and when we begin to make excuses for murderers, as you do, our society is lost.

Whilst I do understand this father's anguish and personal hell he must have gone through to commit this crime, we cannot take the law into our own hands in such a manner, but I don't think his long sentence is justified. What is entirely sad to me is that a 13 year old would commit rape in the first place. That child must have been witness to or subject of abuse soemwhere in his life, and therefore the system had failed long before the rape was committed. With regards to sentencing, I feel that the sentence should be directly related to the crime; eg it takes a lifetime (if ever) to get over rape - LIFE, Murder = LIFEDeath penalty, this poor man's child will suffer for the rest of her LIFE because of this crime, and the boy paid with his life. Justice was served in this way in my view, because with such a system, this child would have been put in a social home at the very worst, out by 16, onto the streets and raping and robbing and worse by 20. Sorry to those bleeding hearts out there, but you rape at 13? Life is not going to pan out well for you, and the system will not work for you. By killing this rapist, the father not only avenged his daughter's rape, but in all probability saved a number of lives down the line too.
