Malema fails to have case chucked out

Julius Malema has failed in his bid to have the hate speech complaint against him thrown out of court.

Johannesburg Equality Court magistrate Colleen Collis this afternoon found that the Sonke Gender Justice Network had established a prima facie hate speech and harassment case against the ANC Youth League President.

But she found that there was no prima facie case of discrimination against Malema for his comments that President Jacob Zuma's rape accuser enjoyed herself with him.

Malema is under fire for telling a gathering of Cape Peninsula University of Technology students that when a woman didn't enjoy sex, she would leave early in the morning.

"Those who had a nice time will wait until the sun comes out, request breakfast and ask for taxi money. In the morning, that lady (Zuma's rape

accuser) requested breakfast and taxi money," Malema said.

"You can't ask for money from somebody who raped you," he said.

Malema remained impassive during Collis's ruling, which lasted less than ten minutes.

His attorney Tumi Mokwena asked for a brief adjournment after the ruling so that he could consult with his client.

The men are now locked in discussion.
