Cape Town - Skywise says its legal representatives have served Airport Company South Africa (Acsa) with a summons for what it said was a breach of contract.

Eyewitness News reports that Skywise suspended operations indefinitely earlier this month after it was unable to meet its payment obligations with Acsa over outstanding airport tariffs.

The low cost airline now claims that at the time of its grounding it was actually not in arrears.

EWN quotes Sykwise co-chairperson Javed Malik as saying that Acsa's decision to ground them at a time when it was holding R1.9 million deposit means they were not in debt.

Acsa has refused to comment, saying its legal representatives are attending to the matter.
