Johannesburg - The Supreme Court of Appeal (SCA) yesterday granted an appeal by Westinghouse over a decision by embattled Eskom to award a contract worth R4.3 billion to rival Areva for the replacement of six steam generators at Koeberg power plant.

The court reversed the decision by the Gauteng High Court that had dismissed an application for a review by Westinghouse.

The SCA found the process followed by Eskom was procedurally unfair.

After being informed its bid was unsuccessful, Westinghouse immediately sought an urgent interdict to stop Eskom and Areva from concluding a contract.
