Johannesburg - Former Eskom boss Brian Molefe wants the Labour Court to order that his dismissal case be taken to arbitration.
Molefe's Advocate Leon Graves said he wants the matter to now be handled via arbitration, instead of the original plea to have his dismissal, earlier this month, be deemed unfair.
Molefe was fired from Eskom by the utility's board in early June following orders from Public Enterprises' Minister Lynne Brown.
Brown had faced pressure from the ANC to fire Molefe even though she had supported his return to Eskom in May, following his short stint as an ANC MP, after he resigned from his position in November last year.
On Thursday Molefe's counsel made arguements at the Labour Court, along with the DA and the EFF. The two political parties were granted access to join the case on Tuesday.
Judge Connie Prinsloo questioned Graves on why she should adjudicate over a matter that was before the High Court, and why this matter cannot be handled there.
The DA and the EFF had brought a case challenging Molefe's return to Eskom arguing that it was irrational, that matter will be heard in August.
Legal counsel for Brown has asked that Molefe's case be dismissed entirely.
While the DA has argued the same, but also questioned why Molefe was intent on the court ordering the matter be sent to arbitration.
The party also argued that Molefe should withdraw the matter and be held liable for costs.
The case continues.
