Theron ‘killer’ on Valkenberg waiting list
Cape Town - The teen accused of killing his girlfriend’s mother is still waiting to be admitted to Valkenberg Psychiatric Hospital to be assessed.
Kyle Maspero appeared briefly in the Western Cape High Court on Wednesday where his pre-trial conference was postponed to August 8 while he waits for a bed at Valkenberg.
Maspero is accused of murdering Rosemary Theron - with his girlfriend, Phoenix Racing Cloud Theron - early last year.
At his last appearance, the court ruled that Maspero be sent for mental observation for 30 days after his lawyer, William da Grass, said his client was having difficulty instructing him because of “a protracted and heavy use of narcotics”.
Maspero had been using tik for an extended period which may have caused brain damage, the court had previously been told.
Prosecutor Susan Galloway requested that the matter be postponed until they had the report.
“He has not yet been admitted and is still on the waiting list,” she said.
Maspero appeared alone on Wednesday - after charges were provisionally withdrawn against his co-accused Godfrey Scheepers.
Scheepers, 20, had previously appeared on charges of murder and defeating the ends of justice, and had been accused of helping to move Rosemary Theron’s body.
Phoenix Racing Cloud, 19, entered into a plea bargain with the State and said she helped Maspero strangle her 39-year-old mother. She said she held her mother’s arms while Maspero strangled her. She was sentenced to 15 years in jail.
She said the couple buried the body in Fish Hoek and later, with the help of Scheepers, moved it to Strandfontein.
Maspero initially wanted to plead guilty, but the State disputed the version of events that he intends presenting when he pleads. He could face a trial. Maspero will remain out on bail until a bed becomes available.
