Johannesburg - Two former municipal managers were apprehended by the Hawks on Friday.

Former acting municipal manager of KaiGarib Municipality, and current HOD of Public Works in Northern Cape Mr Johny Mckay, 58, appeared briefly before Upington Magistrate’s Court last week, facing charges of Contravention of Pension Funds Act.

According to a Hawks statement, it is alleged that between September 2021 and March this year, Mckay failed to ensure that contributions deducted from KaiGarib municipal employees were paid to the consolidated Retirement Fund for Local Government. The Hawks added that the total prejudice to the fund exceeded R9 million.

“The accused was granted R5000 bail and the case was postponed to November 21, for the matter to be transferred to Specialised Commercial Crime Court. Investigation in the matter continues,” said the Hawks

On Friday, former municipal manager of Nkomazi Local Municipality in Malelane, Muzi Daniel Ngwenya, 55, was arrested by the Nelspruit Hawks Serious Commercial Crime Investigation for fraud, theft and contravening the Municipal Finance Management Act.

The Hawks say they carried out an investigation where it was established that during December 2021, the suspect bought a pre-owned Mercedes Benz from a vehicle dealership in Bedfordview, Joburg using the municipality funds.

“He reportedly registered the vehicle in his name, prejudicing the municipality an actual loss of R900 000.

“The suspect appeared before the Tonga Magistrates’ Court on October 28 and he was granted R10 000 bail. The case was postponed to January 25 for further investigation,” said the Hawks.
