Durban — A 19-year-old Wyebank father of one was denied bail in the Pinetown Magistrate’s Court on Tuesday for alleged murder and robbery that took place nearly a year ago.

Ndumiso Malunga was arrested on Friday for alleged murder and robbery that took place last year in October in Wyebank.

Malunga, who is the father to a five-month-old baby girl, is alleged to have stabbed and killed Chigwila Agriba.

The State alleges that Chigwila and his girlfriend had left their residence and headed to a place called KwaNgwenya to buy cigarettes. However, before they could get there, they came across five black males.

“Two of the five stabbed the victim, who is deceased, whilst the other robbed his cellphone. After the incident, the accused fled the area.”

Then last Sunday, police were tipped off about his whereabouts by an informant leading to his arrest at his Wyebank home.

In refusing bail, Magistrate Wendalynn Robinson said that Malunga had failed to present to the court exceptional circumstances permitting his release on bail.

“The test appears to be whether or not the applicant will evade trial. The strength of the State's case is important to consider. The court has to consider all evidence presented before it.”

She said that the court also took into account the accused’s personal circumstances, that he was casually employed, and was a father supporting his daughter.

Robinson denied Malunga bail and the matter adjourned for trial in November.
