Durban — The State is in the process of verifying an alternative address for a 22-year-old man charged with the alleged rape and kidnapping of a 16-year-old in preparation for his upcoming bail application.

It was alleged in the Pinetown Magistrate’s Court on Wednesday that this address was that of a church of which the man’s father is a congregant.

The man, from KwaDabeka, had been expected to apply for bail on Wednesday. However, the proceedings were adjourned for the State to verify an alternative address ‒ that of the man’s uncle ‒ as people residing at the aforementioned address did not want him there.

The man, who is alleged to have raped the 16 -year-old in July, is also accused of assault with the intent to do grievous bodily harm where its alleged that he threatened the teenager with a screwdriver and slapped and hit her with a broomstick and pipe all over her body.

It’s alleged that he locked the teenager in his room until it was morning, refusing to let her go.

In court, the State explained that on the last occasion the man appeared it had been given an alternative address which the investigating officer was to verify.

“The investigating officer was told that they are not willing to take the accused. If there is any other address they can provide, we can verify it. The State is opposed to bail”.

The man’s Legal Aid attorney, T Ramkissoon, with the court’s permission, approached her client and behind him in the court gallery an elderly man provided details of the second, alternative, address, the church.

Magistrate Wendalynn Robinson then postponed the matter, for verification of this address, to November 1 for a formal bail application.

Meanwhile, in the same month that the man will be applying for bail another who was granted R3 000 bail was expected to appear again in court charged with the sexual assault of his 8-year-old niece.

It is alleged that he lives with the child and her family. He allegedly grabbed her and took her into his room, locked the door and removed her underwear before he got undressed and pushed her on to the bed.

It’s alleged that he forced the child to lie on her stomach and penetrated her between her thighs – this is also known as monoamorous simulated intercourse (outercourse).

A relative allegedly saw him pulling up his pants as he walked out of the room.

According to the State, the family assaulted the accused before he was arrested.
