A PHOENIX couple, who have been charged with the murder of the son of a Port Shepstone magistrate, will make their bid for bail at the Durban Magistrate Court today (Monday).

Bryson Kyle Munilall, 27, who was involved in a scuffle outside the Dance Café Nightclub in Briardene, Durban North, with other patrons last Saturday, was stabbed multiple times and declared dead by medics who attended the scene.

He is the son of magistrate Bryan Munilall.

Joeash Govindsamy, 28, and Aveshnee Naidoo, 21, who were arrested at the crime scene, appeared briefly before magistrate Ashwin Singh on Monday before being remanded in custody.

The State was represented by prosecutor Denise Perumal.

Munilall, his sister Caroline and other relatives were believed to be leaving the club around 4am and walked towards their vehicle when he allegedly got into an argument with the accused.

A fight broke out which ultimately ended with Munilall sustaining fatal injuries and Caroline nursing injuries after she was also assaulted.

Govindsamy and Naidoo were arrested at the scene and subsequently charged with murder,

But Chris Gounden, the couple’s attorney, said they denied the allegations made against them.

“They were victims in a fight and deny causing the death of the deceased.”

Gounden’s understanding of the incident was that there was already a fight among patrons happening outside the club as his clients exited. They were drawn into the brawl, got assaulted, sustained injuries and were not certain how the deceased and his sister were attacked.

“They maintain their innocence,” said Gounden.

He said after the couple’s arrest, their vehicle was left unattended at the scene and was subsequently stolen.

Clinton Pillay, owner of Dance Café, said the fight incident happened outside the club, in their car park.

“There is video footage of the incident. The club’s security apprehended those who were involved,” said Pillay.

Munilall’s funeral service was held on Tuesday at the Radiant Life Ministries church in Port Shepstone before cremation.

The family of the former Port Shepstone High pupil were not prepared to comment when approached.
