CAPE TOWN - Traffic chief Farrel Payne will next month go on pre-trial after representations made by him were declined by the Director of Public Prosecutions (DPP).

National Prosecuting Authority spokesperson Eric Ntabazalila confirmed Payne's appearance at the Cape Town Regional Court on Wednesday.

“The DPP in the Western Cape has declined representations made by former Cape Town Traffic Chief, Farrel Payne. Payne is charged with sexual assault, crimen injuria and attempt to commit a sexual act. His case has now been postponed until 19 November 2021 for a pre-trial conference at Cape Town Regional Court,” said Ntabazalila.

Payne, still out on bail of R5 000, remains in the employ of the Department of Transport and Public Works after an internal investigation was conducted and it was found there was "no prima facie evidence against him".

The department’s spokesperson, Jandré Bakker, said that they “carefully considered the allegations” against Payne but concluded “there is no prima facie case to institute formal disciplinary action”.

The woman who lodged a complaint against him is his colleague. She remains on indefinite incapacitated leave.
